Microsoft licenses for online services

It seems that Microsoft has once again done something bad. Well, at
least that's what I read, and I am not that sure about it.

MoonGroup.com are saying[1] that Microsoft's licenses are "heinous and
[..] frightening" because people using their online services
(including Hotmail) "will lose the rights to their own data/content".

They are refering to the license of Microsoft Passport[2], which I am
not familiar with. I am not really sure how that is related to
Hotmail, but Register.COM claimed the same thing[3].

It seems to me that licenses saying that the data sent on online
services (such as discussion boards) belong to the organization
running the service are common. At least, that would not be the first
time I would see one.

Is there something new here?
